S. “If your foreign financial source is from the U.S., you must file an income tax return.” For some taxpayers, including many who have worked overseas, the foreign person, not the alien who resides with the taxpayer in the U.S., is the taxpayer's actual foreign financial source. For these persons, Form 1042-S was created that is used to report their income that is derived from U.S. sources. This is true even for people who, for example, do not reside with the U.S. taxpayer but rather work legally in the U.S. on behalf of the foreign person. The filing requirement applies to foreign individuals who live within the United States and to U.S. multinational corporations. See the instructions for Form 1042-S. “You must provide proof of the filing of an income tax return (Form 1041, U.S. Individual Income Tax Return). If you did not file an income tax return for the year, an individual's income cannot be reduced, modified, or eliminated in any manner and income tax has not been paid on this income. The Form 1040EZ, Individual Income Tax Return, is not acceptable for this purpose. You may need to provide a Form W-2 or other official form with your income tax return. If you did not file a return, you do not pay income taxes. If you will not be filing any tax return for the year, there is no need to provide an income tax return.” Foreign persons who live outside the United States must comply with withholding when they receive U.S. source income (not foreign) that it is.
